Changing the information in a notification

I want to notify a change in the information and documents required for the notification of a trade – e.g.:

  • Change of registered office (natural person)
  • Change in the scope of the objects of business
  • Change in the validity period of the trade authorisation
  • Change in the validity of any of the documents provided
  • Change of delivery address, etc.

For notifiable trades, the notification of changes is regulated by Section 49 of the Trade Licensing Act.

Changing the information in an application for a concession

I want to notify a change in the information and documents required for the application for a concession – e.g.:

  • Change of registered office (natural person)
  • Change in the scope of the objects of business
  • Change in the validity period of the trade authorisation
  • Change in the validity of any of the documents provided
  • Change of delivery address, etc.

For permitted trades, the notification of changes is regulated by Section 56 of the Trade Licensing Act.

Changing the responsible representative

I want to notify a change of the responsible representative for a notifiable or permitted trade:

  • Termination of the appointment of an existing responsible representative
  • Appointment of a new responsible representative for a notifiable trade
  • Apply for approval of the appointment of a responsible representative

The conditions and time limits for acts relating to a responsible representative are regulated by Section 11 of the Trade Licensing Act.

Carrying on a trade – interruption and resumption

I will not be exercising my trade authorisation for a specific trade for some time, or I want to resume a specific trade after an interruption – I need to notify:

  • Interruption of a trade (Section 31(11) of the Trade Licensing Act)
  • Resumption of a trade before the expiry of the period for which the trade was interrupted (Section 31(12) of the Trade Licensing Act)
Establishment

I wish to notify the fact that I am ceasing to carry on a trade at one of my establishments or that I will be starting to carry on one of my trades at an additional establishment and, if appropriate, to notify or change the address at which any liabilities I may have (e.g. complaints about products) can be settled – I need to file:

  • Notification of the commencement and termination of a trade at an establishment (Section 17 of the Trade Licensing Act)
  • Notification of the address at which any liabilities can be settled or, if relevant, notification of a change of this address (Section 31(16) of the Trade Licensing Act)

The Trade Licensing Act imposes an obligation on entrepreneurs to notify of changes in the information and documents specified for the notification of a trade or an application for a concession as well as other facts related to carrying on a trade. Information that is already registered in the listed central information systems of the public administration is exempt from this notification obligation (Sections 49 and 56 of the Trade Licensing Act).
