A newly appointed responsible representative must meet the general and specific conditions for carrying on the trade, and the entrepreneur must provide– as an attachment to the notification of the appointment of the responsible representative or to the application for approval of the appointment of a responsible representative – the relevant documents (e.g. proof of professional competence) and a declaration by the responsible representative that they agree to their appointment. The signature on the declaration must be officially certified unless the responsible representative makes the declaration in person before the trade licensing office, or unless the responsible representative sends a declaration to the trade licensing office signed in the manner equivalent to a handwritten signature (electronic signature). If the responsible representative appointed by the entrepreneur does not meet the conditions for carrying on the trade or if the entrepreneur has not appointed a responsible representative even though they are required to do so by law, the trade licensing office will commence proceedings to suspend the trade. The entrepreneur may only carry on the trade without a responsible representative where provided so by another legal regulation – the trade licensing office will register this fact in the trade licensing register. The entrepreneur must notify the trade licensing office of the appointment of a responsible representative or the termination of their appointment within 15 days from the date of such appointment or termination. The appointment of a responsible representative for a permitted trade must be submitted by the entrepreneur to the trade licensing office for approval, and the trade licensing office will decide on the approval. The entrepreneur must notify the trade licensing office of the termination of the appointment of a responsible representative for a permitted trade within 15 days from the date of such termination.Notifiable trades
