1. Page layout and controls of the Guide

The structure of the Guide web page corresponds to that of the Licensed Trades Portal. In the Guide, the structure of the central frame of the page has been expanded compared to the Portal and the Guide page has the following structure:

  • Page header
  • Menu bar – it is part of the page header
  • Navigation bar
  • Main text of the page
  • Navigation and option buttons
  • Final text of the page (only on some pages)
  • Glossary (only on some pages)
  • Frequently asked questions and answers (only on some pages)
  • Page footer
Page header

It contains basic information about the pages displayed, i.e. the pages of the Guide. In the upper left corner of the header there is a link that takes you to the Licensed Trades Portal, of which the Guide is a part, in the upper right corner you can choose the language version of the Guide (CZ/ENG).

Menu bar

The bar contains links to the main pages of the different sections of the Guide:

Entry into business – information on submissions resulting in the creation of a trade authorisation.

Acts in the course of business – information on the most common submissions made in the course of business activity.

Termination of business – information on submissions by entrepreneurs and acts of the trade licensing office in connection with the termination of a trade authorisation.

About the service – displays this text.

Navigation bar

The bar informs you which part of the Guide contains the information currently displayed. Each navigation item is an active link that allows you to return directly to a specific important page of the Guide.

Main text of the page

Information on the specific issue to which the page is dedicated.

Navigation and option buttons

The navigation and option buttons allow users to view only those groups of information within the Guide that the user is interested in, and conversely, to skip displaying information that the user does not need at that time. Unless the last page of information for the given procedure is being displayed, there are navigation buttons at the bottom of the page that take you to the following subsections of the Guide. Next to each button, there is a brief description of the information that can be displayed using the button.

Glossary

The glossary contains explanations of selected terms relating to the legislative regulation of business activities. If this section is included at the bottom of the page, a brief description of the terms is displayed, and if the Guide contains additional, more detailed information about the given term, the “Detail...” link is provided at the end of the brief description, which opens a more detailed description of the term.

Frequently asked questions and answers

In this section of the page, you will see the most common questions and answers concerning the issues to which the given page is dedicated. By default, a list of the questions available is displayed. To display the answer to a question, click the arrow in front of the text of the question to expand the question.

2. Structure of the information contained in the Guide

The information in the Guide is divided into three main sections:

  • Entry into business
  • Acts in the course of carrying on a trade
  • Termination of a licensed trade

Each section lists the most frequent and most important acts (processes) that are carried out by an entrepreneur or the trade licensing office in that area. The acts are described in a procedural manner, and the process also includes the required particulars of the submission and the specification of the documents that result from the submission (i.e. from its processing) and that are delivered by the trade licensing office to the entrepreneur.

The information within each processes is structured as follows:

  • Basic information – the legal conditions the entrepreneur must meet in order to carry out the act, the administrative fees for the act, the deadlines for the submission by the entrepreneur and the deadlines for the processing of the act by the trade licensing office, and the required particulars of the submission.
  • Further information – any related acts, any submissions can be made to other public administration authorities in connection with the given act.
  • Information on the submission – who can make the submission, where and in what form the submission can be made, links to the official page with the submission forms and the application for preparing and making the submission electronically.
  • Procedure followed by the trade licensing office – a description of the procedure followed by the trade licensing office in processing submissions in different cases (submissions without defects, rectification of defects in submissions, the positive or negative outcome of the processing of submissions).

In addition to the basic groups of information listed above, at key points of the Guide there are links to other processes to help the entrepreneur orient themselves in terms of the types of business entities and the required particulars of submissions that must meet by the various types of entities.

The guide to determining the type of business entity allows the user to determine what type of entity they are or represent by answering simple questions. Once the type of entity has been determined as described above, the user can then select only the information relevant to that type of entity.

3. What is included in the Guide
The Entry into business section:
  • Determining the type of entity
  • Notifying an unqualified trade
  • Notifying a vocational trade
  • Notifying a professional trade
  • Applying for a concession

The information is useful both for obtaining the first trade authorisation (i.e. entry into licensed trades), and for expanding the business activity by obtaining an additional trade authorisation.

The Acts in the course of business section:
  • Changes in the information and documents required for the notification of a trade
  • Changes in the information and documents required for the application for a concession
  • Changes in the responsible representative
  • Interrupting a trade
  • Resuming a trade after interruption
  • Commencing a trade at an establishment
  • Terminating a trade at an establishment
  • Notifying the address of the place where the entrepreneur’s liabilities, if any, may be settled following the termination of activities at an establishment

As part of the processes to change information, there are also processes available to determine the type of entity and the list of the required particulars of the submission (i.e. the list of information and documents) that may vary depending on the given process.

The Termination of business section:
  • Termination of authorisation by expiry of the validity period and the conditions and procedure for renewal, if relevant
  • Application for the termination of a trade authorisation
  • Death of an entrepreneur – the termination of the deceased entrepreneur’s authorisation and the conditions for the temporary continuation of their trade, if relevant
  • Transformation of a company – the termination of a legal person’s authorisation in connection with the merger or division of a company or the transfer of a business share to a member and, if relevant, the conditions for the temporary continuation of the dissolved entity’s trade by its legal successor
4. What you will not find in the Guide

The Guide only contains information on the most common types of submissions in connection with licensed trades and, where relevant, the most common official procedures of the trade licensing office in relation to the entrepreneur and their trades and their registration in the trade licensing register – i.e. the rights and obligations of entrepreneurs and the official procedures of the trade licensing office under Act No. 455/1991 Sb., on licensed trades (the Trade Licensing Act), as amended.

The Guide does not contain information and procedures of the trade licensing office:

  • In the area of dealing with offences committed by entrepreneurs and other persons in connection with carrying on licensed trades
  • In the area of punitive suspension of a trade
  • In the area of punitive termination of a trade authorisation
  • In the area of carrying out trade inspection

If you cannot find the information you need in the Guide, we advise you to contact your nearest trade licensing office, which will provide you with any necessary information.

What you will also not find in this Guide:

  • Information concerning the establishment and creation of a legal person
  • Information needed to perform tax and fee-related obligations
  • Information needed to deal with social security and health insurance contributions.

In these areas, we recommend that you use the information resources of the relevant ministry or contact the relevant state administration authority in the given area.

5. Possible uses of the Guide in specific cases

The information contained in the Guide can be used to obtain the input information needed to make the relevant submission. In addition, the Guide will tell you, among other things, the amount of the administrative fee for your submission, what documents will be issued for you by the trade licensing office on the basis of your submission and what information these documents will contain.

The Guide can also be used to find out what options the trade licensing office has in processing your submission depending on whether or not you rectify defects, if any, in your submission.

Example of use:

After submitting a notification of an unqualified trade, you have received a Request for rectification of deficiencies. You need to find out what happens if you don’t respond to the request. To do that, you can use the Guide as follows:

  1. Launch the Guide and select the [Entry into business] section.
  2. On the “Entry into business” page, choose [Selection of licensed trade] to go to the “Licensed trade” page.
  3. Select the [Notifying a trade] link.
  4. On the “Notifying a trade” page, use the [Unqualified trade] link.
  5. On the “Notifying an unqualified trade” page, select [Procedure followed by the trade licensing office].
  6. On the “Notifying a trade – Procedure followed by the trade licensing office”page, select the [The notification of a trade contains defects] link.
  7. From the “Notifying a trade – Procedure followed by the trade licensing office – The notification of a trade contains defects” page, you can use the [Defects not rectified] link to find out what happens if you do not respond to the Request for rectification of deficiencies and you do not rectify the defects in your submission.

You can use a similar procedure for any type of submission.
