Basic information on continuation after the entrepreneur’s death

Required particulars of submissions

In the notification, the continuing person will indicate the following:

  • The company name or given name and surname of the deceased entrepreneur
  • The personal identification number of the deceased entrepreneur
  • The date of birth of the deceased entrepreneur
  • The birth registration number of the deceased entrepreneur, if assigned
  • Their own (i.e. the continuing person’s) personal identification information, in the following scope: given name and surname, citizenship, date of birth, birth registration number (if assigned), surname at birth and place of birth (municipality, district), address of domicile or address of place of residence in the Czech Republic, if permitted
  • The trade(s) that they intend to continue
  • If they are obliged by law to appoint a responsible representative, the following information on the person of the responsible representative: given name and surname, citizenship, date of birth, birth registration number (if assigned), surname at birth and place of birth (municipality, district), address of domicile or address of place of residence in the Czech Republic, if permitted; the trade(s) for which they are appointed and the date of commencement of their appointment.

If the continuing person is required to make other submissions at the same time, such as the notification of a trade or an application for a concession in the case of continuation after the conclusion of probate proceedings, the required particulars of submissions are specified in the section of this Guide that deals with the relevant type of submission.

Administrative fees

There is no administrative fee for notifying the continuation of a deceased entrepreneur’s trade. If the continuing person requests an extract from the trade licensing register containing information pursuant to Section 60 of the Trade Licensing Act, i.e. proof of trade authorisation in which they are named as the person continuing the deceased entrepreneur’s trade, the administrative fee is set as follows:

  • CZK 20 for each commenced page of a full or partial extract from the trade licensing register.

The administrative fees for acts related to the registration of a continuing person – e.g., the approval of the appointment of a responsible representative for a permitted trade – are specified in the section of this Guide that deals with the relevant type of submission.

  • CZK 50 for the receipt of the submission by the contact point, if the notification of changes is submitted through a public administration contact point (the amount of the fee for the issue of an extract after the change has been made remains unchanged).
Time limits

For the continuing person, the Trade Licensing Act specifies the time limit for submitting the notification of continuation of the deceased entrepreneur’s trade as follows:

  • The executor of the will, heirs at law, testamentary heirs and the surviving spouse or partner must submit the notification of continuation of the deceased entrepreneur’s trade within 3 months of the date of the entrepreneur’s death
  • The administrator of the estate, trust administrator, liquidating trustee or insolvency administrator must submit the notification of continuation of the deceased entrepreneur’s trade within 1 month of the date of the entrepreneur’s death or, if they were appointed later, within 1 month of the date on which they were appointed.


The trade licensing office will process submissions without delay and, if the submission is free of defects, it will make an entry in the trade licensing register within the general statutory time limit of 5 working days.
