Notifying a trade

A trade and the conditions for acquiring and carrying on a trade

Within the meaning of Section 2 of the Trade Licensing Act, a trade is a systematic activity carried out independently under the conditions laid down in the Trade Licensing Act, under a person’s own name and liability, with a view to making a profit. An entrepreneur (or a responsible representative) must meet the general (Section 6 of the Trade Licensing Act) and specific conditions for carrying on the trade, i.e. professional or other competence (Section 7 of the Trade Licensing Act), the entrepreneur (and their responsible representative) must not be subject to any impediments to carrying on the trade (Section 8 or, if relevant, Section 8a, of the Trade Licensing Act), and other conditions specified in the Trade Licensing Act must be met.

Notifiable trades are

1. vocational trades, if the conditions for carrying on the trade include professional competence as specified in Sections 21 and 22 of the Trade Licensing Act,
2. professional trades, if the conditions for carrying on the trade include professional competence as specified in Annex 2 to the Trade Licensing Act, unless otherwise provided below,
3. unqualified trade for which professional competence is not prescribed as a condition for carrying on the trade.

The unqualified trade and the fields of unqualified trade activities are listed in Annex 4 to the Trade Licensing Act – the current version of the annexes to the Trade Licensing Act is available here. In the notification of the unqualified trade, the notifier will indicate the objects of business as “Manufacture, trade and services not specified in Annexes 1 to 3 to the Trade Licensing Act” and all fields of unqualified trade activities that will be carried out by the notifier as part of their business activities.
