Protection of personal data

The public Trade Licensing Register website

is intended for displaying public information about business entities in the Czech Republic registered in the Trade Licensing Register, which is administered by the Ministry of Industry and Trade of the Czech Republic. According to Section 60, paragraph 6 of Act no. 455/1991 Coll., on Licensed Trades the Trade Licensing Register is a public register with the exception of information about fines imposed by Trade Licensing Offices and sanctions imposed by other administrative bodies in relation to business activities and information about birth registration numbers. According to Section 60, paragraph 6, Act no. 455/1991 Coll., on Licensed Trades requires the Ministry of Industry and Trade of the Czech Republic, which carries out activities under the competence of the Trade Licensing Offices of the Czech Republic, to publish the relevant information entered in the Trade Licensing Register in electronic form, in a manner enabling remote access..

Protection of personal data

is realised within the scope of the Trade Licensing Register information system (hereinafter referred to as the TLR IS) and concerning information entered in the Trade Licensing Register and obligatorily published by remote access by means of the public Trade Licensing Register website.

Obligatorily published information concerning processing of personal data when maintaining the Trade Licensing Register.

According to Act no. 101/2000 Coll. (Section 18, paragraph 1, letter b), on Protection of Personal Data, the Ministry of Industry and Trade of the Czech Republic, as the administrator of the Trade Licensing Register administered by means of the TLR IS, is not required to submit a notice of processing personal data to the Office for Personal Data Protection, because the obligation of processing personal data originated on the basis of Special Act no. 455/1991 Coll., Trade Licensing Act, as amended.
In this case the Personal Data Protection Act determines (Section 18, paragraph 2) that information concerning processing of personal data (particularly the purpose of processing, categories of personal data, categories of subjects of data and others, see below) must be made available by the administrator of the information, including by remote access or by other suitable method.

Purpose of processing

Registration and records of entrepreneurs conducting business under the Trade Licensing Act regime, the scope of which is determined by Act no. 455/1991 Coll., Trade Licensing Act, as amended by later regulations, and the related obligation of processing personal data, which is part of registration of subjects and records of these in the Trade Licensing Register.

Categories of subjects of data

Business entities and individuals in a relationship to these business entities entered in the Trade Licensing Register according to Act no. 455/1991 Coll., Trade Licensing Act, as amended by later regulations.

Categories of personal data

Information pertaining to registration and the address of the subject of data.

Scope of published processed data and data that is obligatory according to Section 60, paragraph 6 of the Trade Licensing Act:

With regard to natural persons (entrepreneurs, responsible representatives, heads of organisational units or statutory representatives):

• name and surname,
• state citizenship,
• address or place of residence in the Czech Republic,
• date of birth,

with regard to business entities:

• registration number,
• trading company or name,
• site of business or registered office,
• identification and address of the enterprise's organisational unit situated in the Czech Republic.

Sources of personal data

Subjects of data announcing personal data within the scope of notification of a trade, request for permit or announcement of notified changes according to Sections 45, 49, 50 and 56 of Act no. 455/1991 Coll., Trade Licensing Act, as amended.

Description of the method of processing personal information

Automated processing at individual Trade Licensing Offices (hereinafter referred to as the TLO) on all levels by means of the TLR IS.

Site of processing personal information

The registered offices of Municipal Trade Licensing Offices, Trade Licensing Offices of the City Districts of the Capital City of Prague, Regional Trade Licensing Offices and the Ministry of Industry and Trade as the body executing activities under the competence of the Trade Licensing Office of the Czech Republic.

Recipient or categories of recipient of personal data

• Employees of individual TLO on all levels of the TLO,
• The public and internet users.

Description of measures for assurance of the required protection of personal data according to Section 13 of Act no. 101/2000.

On the basis of Section 60, paragraph 3 of Act no. 455/1991 Coll., Trade Licensing Act, as amended by later regulations, the Trade Licensing Register is a public register, with the exception of information concerning fines imposed by Trade Licensing Offices and sanctions imposed by other administrative bodies in relation to business activities and information about birth registration numbers. According to Section 60, paragraph 6 the TLO of the Czech Republic is required to publish this information in electronic form in a manner enabling remote access to this information.
